Welcome to Domain Observation. By using our service, you agree to these terms.
1. Service Description
Domain Observation provides a domain monitoring service. We check domain availability and notify you via email when a domain becomes available. The service requires an account and a yearly subscription per monitored domain, which renews automatically until cancelled.
2. User Responsibilities
You agree to provide accurate email addresses and use the service for lawful purposes only. You may not use automated systems to abuse our service.
3. Disclaimer
We provide this service "as is" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Domain availability information is obtained from third-party WHOIS services and may not always be accurate, complete, or up-to-date. We do not guarantee the accuracy, reliability, or timeliness of any information provided. We are not responsible for missed notifications, delayed notifications, incorrect information, or any technical failures.
4. Limitation of Liability
To the fullest extent permitted by law, Domain Observation and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: (a) the use or inability to use our service; (b) missed domain registration opportunities; (c) domains registered by third parties; (d) inaccurate or delayed notifications; (e) any errors or omissions in domain availability information; (f) any unauthorized access to or alteration of your data; or (g) any other matter relating to our service. This limitation applies regardless of the legal theory upon which the claim is based.
5. Changes to Terms
We may update these terms at any time. Continued use of the service constitutes acceptance of the new terms.
6. No Guarantee of Registration
Domain Observation is solely a notification service. We notify you when a domain becomes available, but we cannot guarantee that you will be able to register it. Other parties may also be monitoring the same domain or may register it before you do.
7. Multiple Subscribers
When multiple users subscribe to the same domain, all subscribers receive a notification simultaneously when the domain becomes available. Registration is on a first-come, first-served basis. We do not give priority to any subscriber.
8. Notification Only
We do not register domains on your behalf. After receiving a notification, you are responsible for registering the domain yourself through a domain registrar of your choice. We are not liable for any delays in notification delivery or for domains that are registered by others before you can act.
9. Payments
Domain monitoring is a yearly subscription of €9.99 (excl. VAT) per domain. After the first payment, Mollie automatically charges this amount each year to renew the subscription. You can cancel at any time from your dashboard to prevent future charges. Payments are non-refundable unless required by applicable law.
10. Cancellation
You can cancel your subscription at any time from your dashboard. Cancellation takes effect immediately: no further yearly charges will be made. The current paid period remains active until its end date; we do not issue pro-rata refunds for unused time.
